Terms of Service for ToneRig

Please read these Terms of Service (“Terms”) carefully before using ToneRig (“the App”), operated by Joshua Aquino (“we,” “our,” or “us”).

By downloading, installing, or using ToneRig, you agree to be bound by these Terms and by the Apple Licensed Application End User License Agreement (see the separate EULA). If you do not agree, do not use the App.


1. Acceptance of Terms

By using ToneRig, you confirm that you are at least 13 years of age (or the minimum age required in your jurisdiction) and that you agree to comply with these Terms.


2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use ToneRig on Apple-branded devices that you own or control, subject to these Terms, the EULA, and the Apple Media Services Terms and Conditions. Permitted use and restrictions are detailed in the EULA.


3. Equipment and Use Requirements

ToneRig is a real-time audio processor intended for use with a class-compliant USB audio interface and an instrument. You are responsible for the equipment you connect and for using the App at safe listening levels.

Hearing safety: Audio processing — particularly high-gain amplifier models — can produce loud output and feedback. You are solely responsible for setting safe monitoring levels. Disable direct/hardware monitoring on your interface where appropriate to avoid combined dry/processed signals and feedback. We are not responsible for hearing damage, equipment damage, or other harm resulting from output levels, feedback, or your audio configuration.


4. Your Content and Files

You retain all rights to the audio you play and to any model (.nam) or impulse response (.wav) files you import. These files and your presets are stored on your device; we do not access, collect, or receive them. You are responsible for ensuring you have the rights to use any files you import.


5. Third-Party Services and Content (TONE3000)

ToneRig offers optional integration with TONE3000, a third-party service, for browsing and downloading neural amp models. Your use of TONE3000 is governed by TONE3000’s own terms and privacy policy. We do not control TONE3000 and are not responsible for its content, availability, accuracy, or any models you obtain through it. Models and tones provided by third parties may be subject to their own license terms, which you are responsible for honoring.

ToneRig is an independent product and is not affiliated with, endorsed by, or sponsored by TONE3000 or the Neural Amp Modeler project. “Neural Amp Modeler,” “NAM,” and “TONE3000” are the property of their respective owners.


6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable law.
  • Reverse-engineer, decompile, or disassemble the App, except to the extent that applicable law expressly permits.
  • Rent, lease, lend, sell, redistribute, or sublicense the App.
  • Remove or alter any proprietary or open-source notices in the App.

7. Intellectual Property

ToneRig, including its design, original code, features, and branding, is owned by Joshua Aquino and protected by intellectual property laws. ToneRig incorporates third-party open-source software under its own licenses; those notices are reproduced in the App under Settings → About & Legal → Acknowledgements and in the project’s THIRD_PARTY_NOTICES file. Nothing in these Terms limits your rights under those open-source licenses.


8. Purchases

If ToneRig is offered as a paid app or includes in-app purchases, all transactions are processed by Apple through the App Store. Pricing is shown in your local currency at the time of purchase. Refund requests are handled by Apple at https://reportaproblem.apple.com; we do not process refunds directly.


9. Disclaimer of Warranties

TONERIG IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, compatible with any particular audio interface, or free of latency, dropouts, or audio artifacts.


10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JOSHUA AQUINO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION HEARING OR EQUIPMENT DAMAGE, LOSS OF DATA, OR LOSS OF PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF TONERIG. OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM, OR USD $50, WHICHEVER IS GREATER. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.


11. Governing Law

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located in Metro Manila, Philippines, except where applicable consumer-protection law provides otherwise.


12. Changes to These Terms

We may update these Terms from time to time. When we make significant changes, we will update the “Last Updated” date above and post the revised Terms at their public URL (https://joshaquino.com/tonerig/terms). Continued use of ToneRig after changes are posted constitutes acceptance of the updated Terms.
