End-User License Agreement (EULA) for ToneRig

Effective Date: June 28, 2026

This End-User License Agreement (“EULA”) is a legal agreement between you (“User”) and Joshua Aquino (“Licensor”) for the use of ToneRig (“the App”).

By installing or using ToneRig, you agree to be bound by this EULA. If you do not agree, do not install or use the App.

This EULA supplements the Apple Licensed Application End User License Agreement (the “Standard EULA”), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of a conflict between this EULA and the Standard EULA, this EULA governs to the extent permitted.


1. License Grant

Subject to your compliance with this EULA, Joshua Aquino grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use ToneRig on Apple-branded devices that you own or control, as permitted by the Apple Media Services Terms and Conditions and the Usage Rules therein.


2. Restrictions

You may NOT:

  • Copy, modify, or create derivative works of the App, except as permitted by applicable law or by the open-source licenses governing components of the App.
  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the extent applicable law expressly permits.
  • Rent, lease, lend, sell, redistribute, or sublicense the App.
  • Remove, alter, or obscure any copyright, trademark, or proprietary notices, including the third-party open-source acknowledgements reproduced in the App.
  • Use the App for any unlawful purpose.

3. Open-Source Components

ToneRig includes third-party open-source software licensed under the MIT License and the Mozilla Public License 2.0. Those components remain governed by their own licenses, and nothing in this EULA limits your rights under them. The applicable notices are reproduced in the App under Settings → About & Legal → Acknowledgements and in the project’s THIRD_PARTY_NOTICES file.


4. Intellectual Property

The App, including its original content, features, functionality, design, and code (excluding third-party open-source components), is and remains the property of Joshua Aquino. This EULA does not grant you any ownership rights. Any feedback or suggestions you provide may be used without obligation to you.


5. Equipment, Audio Output, and Safety

ToneRig processes audio in real time and can produce loud output and feedback, particularly with high-gain models. You are solely responsible for your audio configuration, monitoring levels, and equipment. Licensor is not responsible for hearing damage, equipment damage, or other harm resulting from output levels, feedback, latency, or your use of audio hardware with the App.


6. Updates

Licensor may release updates, patches, or new versions of the App. Some updates may be required for continued use. Licensor is not obligated to provide updates, maintenance, or support.


7. Termination

This EULA is effective until terminated. It terminates automatically if you fail to comply with any term. Upon termination, you must cease all use of the App and delete all copies from your devices. Sections that by their nature should survive termination (including Sections 4, 5, 8, and 9) will survive.


8. No Warranty; Limitation of Liability

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. LICENSOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND DOES NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, AND LICENSOR’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR USD $50, WHICHEVER IS GREATER.


9. Governing Law

This EULA is governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles.


10. Apple as Third-Party Beneficiary

You acknowledge that this EULA is between you and Joshua Aquino only, not with Apple. Apple is not responsible for the App or its content. However, Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you. Maintenance, support, warranty claims, product-liability claims, and any third-party intellectual-property claims relating to the App are the responsibility of Licensor and not Apple, as further described in the Standard EULA.
